Reality Television: Good or Bad Essay

Most teens perceive reality television programs in different views and for different reason. Teens even have different reactions to viewing these reality television programs whether it is a negative reaction or positive reaction. Parents never consciously think of how the impact on these programs or what their teen is really watching until they become involved. Some parents view these programs and think they are too influential and ban the programs from the home (the strict parent). Other parents indulge with their teen’s life and want to know what they are watching to relate and provide guidance to them. Is it possible to be either parent or both? It is easy to point the finger and believe that someone is taking your teen away with false envisions. While reality television can provide false envisions, parents should be involved in watching reality television programs with their teens because it provides them entertainment, teens will subconsciously hear their parents guidance while watching these programs, and it allows them to make a sound judgment on their own character. Why do teens really watch reality television programs? Popular reality television programs such as Bad Girls Club, American Idol, Love Games, America’s Top Model, and the list could go on, have one thing in common they provide entertainment for teens and pre-teens. These reality programs provide an entertaining way for these teens to share their views in school, and it is part of their social lives at some degree. The teens are able to connect with their friends and discuss these programs either to laugh at their ridiculous morals on the show, their likes and dislikes, or even whom they feel they relate more to. It is a form of connectedness to these teens. Connectedness is defined as the â€Å"level of intensity of the relationship(s) that a viewer develops with the characters and contextual settings of a program in the para-social television environment;† the higher the connectedness, the more involved the viewer is with the program and characters (Russell et al., 2004). (â€Å"The Appeal of Reality Television For Teen a nd Pre-Teen Audiences,† 2011) Teens find themselves relating and having a social-life in school, on social websites such as Facebook and Twitter, and they are able to communicate via text or phone conversations. Of course the parents are not happy with some of the programs but it is nice to know what our teens are watching so that we can be in tune with how are teens are developing. With the continued popularity of reality television among young viewers, it is vital to identify pre-teen and teen audiences who not only watch a reality program but have a high level of connectedness to it. Connectedness extends beyond just viewing the program and involves further engagement—posting on social networking sites, for instance, or buying products placed on the show. (â€Å"The Appeal of Reality Television For Teen and Pre-Teen Audiences,† 2011) The punch-lines of these reality television programs provide an addicting and exciting rush full of tense drama and romance that teens thrive for. As parents, we watch these programs to see how the teen is relating to these programs, possibly to see if there is potential belief in what they see. Just like typical movies there is slight distortion to what is real. Even with reality television programs there is distortion to the time things that could take months or years to accomplish happens in about a week on these reality television programs. Reality television programs are set up to gear to the audience and if it means giving the audience what they want than they go to any means necessary to keep their ratings up. Two key factors keep our interest and entertain us. One factor, we watch the tense drama or suspense week after week to gain entertainment. Watching reality TV is like watching a traffic accident. The ordinary reality show is just glass shattered on the highway, fire trucks, stretchers, the Jaws of Life. Occasionally a show is so unbelievable it is like watching a car filled with children from the inner city going to a Fresh Air Fund camp slam a minivan full of widows and orphans on their way to play the slots in Atlantic City (Kitman, 2008). The other factor is humiliation, which is a key to reality television programming. People who are in these programs are real people who are trying to get their fame, even if it is for a season or day. They could care as much of the humiliating experience they are on national television (Kidman, 2008). With these factors in mind it is easy for teens to be entertained by these programs. In fact, adults watch these programs as entertainment as well. The issue is the extreme will the producers realize the stopping point? They will not, the viewers are the ammunition. A parent has the ability to watch these programs as a mentor with their teens, if not with him or her, behind the scenes, to stay up on what is going on to stay ahead of the times to relate to their teens. Parents most scary thought is watching their teens turn into young women and men. How can we still be the parent who is cool and still teach our teens? Being active, it is easy to fall into our everyday busy lives and not even see what can be prevented. Being active does not mean be that stalking mother or father but proactively know what is going on in your teen’s era or generation. Romantically themed Reality television programs can be a struggle when teens are seeing different perceptions on how love is being perceived. Studies show that teens who view these shows male or female it has a negative impact on the sexual desires of the teen. Whatever happened to the old way of being lifetime friends and falling in love? A romantically themed reality television program becomes one of those television programs that not only entertain but it entices the teen to sexual conversation and risk. The studies show that teen girls are more prone to have the connectedness and conversation with their friends, and the males are more pressured into having sex (Vandenbosch & Eggermont, 2011). Parents should take the time to view these programs, to at least get a summary of the topics in the programs to actively be involved in what their teen is instilling subconsciously. Sex can be a subject that we may not want to face with our teens, but it is happening daily. Showing the teen that these shows are a mere false pretense of a relationship and being open to this conversation will give the teen that opportunity to see the reality of it and still feel that they are in control. Having the awareness that the sexual communication in these television programs will be increased, parents can effectively have an intimate conversation to present to the teen there are risks involved and there is exaggeration in what they are viewing in the entertainment world of these programs. Studies show that the main reasons the teens watch these romantic themed reality television programs is to entertain or escape, habit, mood- regulating motives, peer connectedness, and peer conversation (Vandenbosch & Eggermont, 2011). Parents can use this knowledge to assist in relating to the teen and providing different outlets to steering them in different directions to keep the grounded and equipped with the knowledge needed. Entertainment is evident to allow teens to be ent ertained knowing the difference between real and exaggeration. In escape allow them to watch these with alone to capture their own view without influence. Allowing the individualism will create that moment of individuality after parent did his or her job. Habitual viewing of these shows their dedication to the show and how well they connected to the characters or moral. It shows they are anticipating on the results or ending. Mood regulating motives shows that if they had a long hard day the relief of some entertainment relieves them from that stress and can watch carelessly, a reality television program for a quick laugh or escape from the stress they encountered. Peer connectedness is where the teen can compare with their friends the results of the final thoughts of the episode they have viewed. We do that effortlessly during and after a show or program of any sort, even a movie. Conversation amongst teens can be intense depending on the show they viewed or watched. This could be anywhere from a sexual conversation to a little comparison in the fight that took place on a show. Teens watch reality television for a numerous reasons, but they are also smart enough to know right from wrong. Teens are equipped with wisdom and knowledge f rom their parents and will use and compare a lot of that information to make their own mistakes. Knowing this information the teen can make a sound decision and with process of elimination can actively be a popular teen and still pick out of these reality programs life lessons that will carry them in their future. Shows like Jerry Springer, Bad Girls Club, America’s Top Model, and American Idol are all reality shows with different messages to the public. Some of the messages are negative or positive. â€Å"Teens are naturally curious about other people’s lives and want to know how their own lives compare,† she says. And they often look to reality shows for answers. Young people also tend to watch shows with older characters to learn what it will be like when they get to that age, according to David Bickham, Ph.D., staff scientist at the Center on Media and Child Health at Children’s Hospital Boston (Is Reality TV Messing With Your Head?, 2012). Parents’ job is never finished, the thought that was my teen instilled with good moral? Have I done all I could to build my teens esteem and character? These questions and more are parent’s dreaded questions because they do not want to fail as parents. Reality these reality television programs are meant for entertainment and to give an idea of how life could be. The factor of exaggeration is considered by the teen. The biggest question is where is my teen’s mindset? Teens have a connection with these reality television programs not so much to mirror what they see but to communicate with others including the parent. The degree of influence these shows have might depend on how you feel about yourself, not just how you feel about the characters you see on TV. â€Å"If a teen is struggling with self-esteem issues, he might adopt some of these attention-getting behaviors to get recognition,† says Gottlieb. â€Å"If, however, you’re confident in yourself and have positive sources of attention, such as sports or theater or good friends, you’ ll probably see the Kardashians or The Situation as ridiculous, not role models (Is Reality TV Messing With Your Head?, 2012). What parents instill in the teen will determine the outlook of the teen ad how much the parent will have to work with their teen. Reality television programs can be entertaining and educational, and can open up new worlds for kids and teens, giving them a chance to travel the globe, learn about different cultures, and gain exposure to ideas they may never encounter in their own community (University of Michigan Health System, 2010). â€Å"Reality shows are not meant to inform or educate (like news), not produced in order to persuade or influence (like political advertisements), and do not necessarily or instinctively evoke negative feelings in subjects when used by researchers as a stimulus as media violence, pornography, or death metal lyrics do. Even though reality television can provide false envisions, parents being involved in watching reality television programs with their teens provides them entertainment, they will hear your guidance on what is being viewed, and it allows th em to make a sound judgment on their own character. When you actually think about all the reasons reality television programs are viewed they seem to all tie together. Reality television programs create that momentum for teens to be informed, entertained, and allowing them to create their own reality as an adult. Teen’s motives are not always as they seem. They may start off showing a negative response to the programs and then flip and show positive responses just to interacting with others and gaining that chance to be their own and make decisions. Enabling teens to watch the reality programs they are able to communicate what they viewed and have the social life. Teens are also able to view these reality programs with a critical eye to take the bitter with the sweet with every show to be their own judge. Finally just to have that great entertainment moment in a day is worth laughing, relating to, or even comparing to. Are you a parent finally realizing that teens are going to view these programs and make mistakes that are at times difficult to witness. Parents being involved with their teens although will be difficult will overcome the storm they will encounter but it will be worth the fight in the end. British Airways- Case Study Essay

The scenario upon which this paper is based relates to the British Airways Swipe Card Debacle case study from the textbook, Managing Organizational Change: A Multiple Perspective Approach (Akin, Dunford, & Palmer, 2009). The purpose of this paper is to analyze and discuss the organizational change associated to the implementation of a new swipe card system that led to strike of over 250 British Airways check-in staff, losing 40 million pounds and negatively effecting the company’s reputation. Additionally, this paper will relate the case study to several change approaches (organizational development, sense-making, change management, contingency, and processual) and identify key issues. Additionally, this paper will examine the case study from my perspective, as if I were a hired change consultant for British Airways responsible for providing advise and recommendations on how to avoid this type of situation. Additionally, as a change consultant, I provide my recommendation as t o what possible change approach or combinations of a change approach would have been best to use for the swipe card change initiative. Change Perspective and Key Issues Prior to going into being able to effectively provide advise and recommendations on this case study, it is first important to discuss aspects of different change approaches. Additionally, relate key issues of the swipe card debacle to these change approaches. With that, this section paper will focus on identify specific aspects of the following change approaches and how these aspects relate to the case study: organizational development, sense-making, change management, contingency, and processual. Organizational Development Approach The organizational development change approach is a well thought through and thoroughly planned change approach that focuses on staff development. Additionally, one of the key aspects to the organizational development approach is the importance placed on the need to form groups and teams, which work together to form the key focus for change (Akin, Dunford, & Palmer, 2009). Unfortunately, this very important characteristic of organizational development approach was truly not used as part of the change approach for the swipe card implementation. For instance, if groups and  teams were created to form the key focus for the change, none of the 250 check-in staff were invited to participate. Sense-making Approach The sense-making approach is very similar to Kurt Lewin’s organizational change model. At a high-level, this model has three primary stages known as Unfreeze (identifying where the company is at, in relation to environmental change and organizational structure), Change (period of time where the change is being made), and Refreeze (change is complete and the organization has embedded the change within its culture) (Levasseur, 2001). However, there is one slight difference with the sense-making approach, in that the second stage is more the about rebalance where the organization balances the external environment with its internal environment. An example of a key issue associated to this from the case study is the fact that it appears those responsible for the Future Size and Shape recovery program, did not take the first stage into consideration. More specifically, the group did not factor in how the company was still recovering from environmental changes such as, 9/11, Iraqi wa r, and SARS. Additionally, did not consider if this was the right time for this type of change. Change Management Approach There are several different change management approaches but the one focused on within this paper is the change management approach Ten Commandments approach, developed by Rosabeth Moss Kanter, Barry A. Stein, and Todd D. Jick. In the book, The Challenges of Organizational Change, Kanter, Stein, and Jick elaborate on what they believe to be the necessary steps to effectively implement change within an organization. One of these steps, which is something that was not executed in the swipe card debacle, is the step to create a shared vision. While the Future Size and Shape project team may have had a shared vision of the swipe card change, this same vision was definitely not shared by the 250 check-in staff. Contingency Approach Similar to the change management approach, the contingency approach has many different variations. For instance, one of these approaches is categorized into the following four ideal types: commanding (change intervention, directed by leadership and is typically driven by the need to implement  quickly and abruptly), engineering (change agent, who also acts as an analyst implements the change along with those who designing the change to process and systems), teaching (third party consultants work with internal staff to assist with identify new ways of operation and is change intervention that is a long-term plan), and socializing (democratic approach that is a gradual change process approach) (Huy, 2001). Each of these approaches are acceptable but may not all work in every type of situation. For instance, within the British Airways case study, it seems as though the project team chose to utilize the commanding approach for the implementation of the swipe cards. The check-in staff w ere completely resistant to not only the swipe card change but were also resistant to the actual approach taken to implement that change. Processual Approach Similar to the sense-making approach, the processual approach also looks at the relationship of external and internal environments. However, with the processual approach, it focuses on the constraints and opportunities of both environments. Within the case study, the project team did not take into consideration how the external environment impacts the internal environment and how the internal environment also effects the staff. For instance, the staff being on edge and untrusting of change was a result situations and changes both internally (one forth reduction in staff) and externally (environmental jolts like inroads on its markets from budget competitors). The combination of these situations, led to the staff being fearful and overreacting to the possibility that the new swipe card process could lead to another reduction in staff. Change Consultant As a change consultant for British Airways, I would provide the following list of lessons learned from the swipe card debacle: lack in including those directly affected by change can lead to staff being uncomfortable and uncertain about a change; lack of taking internal and external environments into consideration is not fully understanding the cumulative effect that these have on the staff; taking a commanding approach to implement change can lead to staff disagreeing with the way a change is being managed; and lack of communication and gaining buy-in on change can led staff to believe that the change could have negative downstream impact. In order to prevent this in the future, I would advise them to take a different approach by having staff be more involved with projects and include them as part of the project teams. Additionally, allowing the staff time to absorb the fact that there will be changes in the future and giving them a platform to be able to ask questions. In addition to providing the staff a platform, leadership also needs to encourage the staff to ask questions and ensure them that there will not be any backlash for those who do have questions about the change. Lastly, as a change consultant, I would emphasis the importance viewing the organization from a birds-eye view (meaning that leadership the context of the situation from an internal and external perspective). If they would have stepped back and looked all the external and internal factors prior to implementing the swipe card change, they may have seen that implementing change over a holiday weekend might not be the best time, they might have iden tify staff moral being low due to internal reduction in force, and the fact that the company was struggling to recover from other external environmental jolts. While there are many change approaches that may be suitable for this type of change initiative, it is my opinion that the best approach for this change would have been to use the Ten Commandments change management process. The reason for this is that it would have resolved and possibly prevented the reaction that staff had towards the implementation of swipe card because this change approach includes creating a shared vision, involving staff, having the support of leadership and political sponsorship, and developing an implementation plan (Barry, Kanter, & Jick, 1992). Conclusion Based on the information provided in the case study about the swipe card debacle at British Airways and comparing key issues to various change approaches, it can be seen that there are many areas where management taken a different approach to the change. If a different approach was taken, it could have easily lead to a successful swipe card implementation versus the outcome that lead to the 250-check in staff, losing 40 million pounds and negatively effecting the company’s reputation. My Home Purchase Plan

Under this Plan, the Government will provide land for the HKHS (Hong Kong Housing Society) to build â€Å"no-frills† small and medium flats for lease to eligible applicants at prevailing market rent. The tenancy period will be up to five years, within which the rent will not be adjusted. Within a specified time frame, tenants of the Plan may purchase the flat they rent or another flat under the Plan at prevailing market price, or a flat in the private market. They will receive a subsidy equivalent to half of the net rental they have paid during the tenancy period, and use it for part of the down payment. The Government has already earmarked sites in Tsing Yi, Diamond Hill, Sha Tin, Tai Po, Tuen Mun and other areas for a total of some 5000 flats to be built under the Plan. The first project will provide about 1000 flats in Tsing Yi by 2014. In the point of view of the Government, they would like to wisely spending the money of helping the sandwich class with flexibility in their home purchase plan, including the choice of opting to purchase the flat they rent, another flat under the plan, or a flat in the private market; which also want to help on slowing down the raising on both rental and purchasing prices currently in the market. The Government thinks that the current price in the market has been raised too fast and too high which is not a health saturation and start forming up an â€Å"Economic Bomb†. As the â€Å"Property Market† is one of the main factors with Hong Kong’s economic environment, if the â€Å"Bomb† pops, Hong Kong’s economic will be affected badly. But in the other hand, the Government does not want to affect the growth of the real estate too much and too fast, therefore the Government implies with this soft plan in order to balance with the situations. For the tax payers, they are mainly separated in to 2 groups: the group which cannot enjoy with the plan and the qualified applicants. For those who do not have the right to enjoy with the benefits are mainly the people who are either already owning a flat, or those people who are not qualified due to higher incomes. These people might not feel happy with the Government’s actions. For those who have already owned their own place, when the Government supporting plan comes, that means there will be more people able to buy their own place. In the last few years, the economic situation of Hong Kong was not good and people were very careful on using their money, which made the banks dropped their interest rate of borrowing in order to attract people to borrow money either on buying flats or other usages. With the needs on mortgaging is rising due to this program, the interest rate will then have the potential on rising. This will affect to those people who already own their own place for living have to pay more on the mortgage pay back or need to extend the time of pay back as the raising of the interest. The Government has setup very tight rules on the incomes and assets on qualifying the applicants for the supporting program in order to make sure all the qualified applicants are the users of the properties. Those people who do not qualify for the program due to higher income might be the most unhappy group as they would think the Government does not take care of them. Since the property prices have been increased so much in the last 5 years, although they have higher incomes, they still cannot afford the down payment on purchasing a place. For the group of people who are the qualified applicants, of course they will be very concerned for this supporting program. However, they have to wait until the second half of 2014 for the building completion and there will be only 5000 units, which is really â€Å"Too Little Too Late! † Another problem is that, the Government now estimating that the price of a 500 feet unit is 3 million, which would only apply to those flats in the remote areas. The prices for the urban residents are already far outstripped with it. Who can predict and guarantee how would the real estate pricing will be after 7 years of time (The planned building will be completed after 4 years, the applicants have to rent and live there for 3 years before they can own)? In case of the property prices continue rising, those 300 thousand which is going to be rebate from the Government still not enough to pay for the down payment. If the property prices rapidly decline, those applicants will be falling into a dilemma situation. Overall, to solve the housing difficulties of Hong Kong there are many ways, how the â€Å"My Home Purchase Plan â€Å"may receive with the desired results really depends on the future development of the real estate market trends. However, the â€Å"My Home Purchase Plan† does not really may not really be able to help on the current unhealthy situation on the property market. In my opinion, I would suggested the Government should plan on some relaxation on the income limit for public housing and pay more attention on taking care of the middle and lower class families. In fact, the magnitude of increase in property prices and rents, is seriously out of the line with the general public’s income, which directly affecting the quality of life. The Government should pay more attention on how to plan on the public housing supply and how to make better use of resources balance.

Further, Red book also offers more opportunities and time to the contractor to receive and evaluate information pertaining to the risks’ factors in the project. This will enable the contractor to conceive these risks and to offer his price to the project accordingly. Contractors employing the FIDIC Red Book will find is useful to comprehend how the FIDIC documents allocate and classify the various perils so as to forbid the cost overruns and losses that may be sustained on the problematic provinces of the project. Here, the contractor has to consider the risks associate to the capability of the contractor, physical risks, time-associated risks, economic risks, construction and eng ineering risks and other risks3. In Fidic red book, Contractor’s risks are detailed in clause 17.003. The Contractor will be held accountable for the following risks. Any loss or personal injury to employees or property due to Contractor’s wilful act, negligence or breach of contract or personal injury caused due to faulty design by the contractor. Loss caused due to Employer’s privilege to occupy any land or to have work executed. This I can achieve by taking up the self improvement courses and with the help of my friends and family. I will also practice this in all aspects of life so that I do not become a push over and people do not take advantage of me. In conclusion I feel that this assessment of my nature and personal managerial competence is very accurate. The ENFJ category of people are referred to as, ‘the Caregivers’, which I feel is a true portrait of my nature. It is for this reason that I believe being a lady or gentleman is based on personality, how a person treats others, I speak for most people who use the term â€Å"ladies and gentlemen† in reference to a person’s conduct, not a person’s class, social standing, race, sexuality. Some, when faced with the terms â€Å"ladies and gentlemen,† will immediately assume the worst by using the outdated definitions. Some will also dig for reasons to label those who use â€Å"ladies and gentlemen†. In labeling us this way, these people do not facilitate any sort of progress for the terms or for any sort of unity for women, or men, ladies or gentleman. We live where we ought to not judge people by the color of their skin, their class, gender, or sexuality, with all of this, there are still groups who refuse to take off their blinders. In a survey conducted I was able to poll ten people and from vary ages and backgrounds. Although they all had varies opinions on what a lady and what a gentleman is. It was a little redundant on what the ladies had to say concerning their definitions, and what the men had in their responses. The simple fact from the ladies side was mostly about the dress of a lady and how they carried themselves in public. However on the men’s side of the scenario it was mostly about them being of a maternal instinct, and mannerisms of a lady one being polite, sincere and genially whole. However when it came to the Gentleman part of this survey it was all about having decent employment and being a good provider, and once again a good father figure. Funny as it seems this was from both the male and the female’s opinion. My age bracket was from one, my son who is twenty one, to my neighbor who is in their sixties. The ladies were a woman in their mid twenties to my mother in her late seventies. Their vocations were that of manufacturing to one of a professional woman a teacher. However it was an interesting fact when I asked these questions to my girl who was brought up well as she calls it blue blood, or if you will high society and her idea’s and experiences being brought up to be a lady. The fact that she was taught to courtesy in her early years and to have proper mannerisms of that type of upbringing to be able to be presented to other able blue blooded men at eighteen for a possible mate to ensure of proper breeding from their bloodline was somewhat a crazy response to my questions on being a lady or a gentleman. Therefore to some things up and to suggest whether or not I agree with Castiglione and his descriptions of a woman and that of a man or should we say a lady and a gentleman? To be or not to be the real question, a woman, lady or man or gentleman. Therefore I will share my opinions on the positives, I see fit and the negatives that I believe could be harmful to ones general character. To be born out of nobility would be an awesome deal but when and where we were born and the freedom of choice in our upbringing is one I am a little half and half on if that makes sense, in other words I do believe it is wonderful to be born with your parents and having them part of your life to help guide you, and to prevent errors in their culture to help make you a well rounded person. However to feel that a judgment is made upon you from whose family you were born into and how you were to dress and what reactions one would have towards you because of your nobility at birth and being told you believe this way or that way I feel is wrong. Therefore to be judgmental of the skin the dress and down to the language and how it is spoken to others and to deem their worthiness by a person’s size is a little farfetched but perhaps in that century the judgment rang true of a person’s actions be it male or female. To be a lady who plucks eyebrows or powders their face, or to be a wanton women to honest men or I believe the proper term here is harlot. Men of good posture and build for fighting wars or one whom is of a cowardice nature, but what of those men who flatly just did not measure up to the standards of a fighter for wars. In our society today we are somewhat powerless of what our physical stature is to become and therefore almost impossible to say what we will become and surely plays an important role in the attitude towards that.

Burglary of a Dwelling Conviction MEMORANDUM TO: Senior Partner FROM: Associate RE: George Bailey Burglary of a dwelling conviction DATE: July 11, 2016[FEC1] ISSUES PRESENTED Under Florida case law[FEC2], entering is an element of burglary. Entering qualifies as any [FEC3]body part and is not secluded to the whole body. Defendant put his arm through an open garage window to commit a burglary[FEC4]. Did Defendant meet the element of entering as it pertains to the burglary statute? Under Florida statute, dwelling is an element of burglary. For any building to be considered a dwelling, the property in which it resides must have curtilage[FEC5]. Curtilage is some form of enclosure surrounding a property. While standing on the neighbors property, Defendant burglarized[FEC6] a detached garage on a property that was enclosed on three sides, with the fourth side open. Did Defendant meet the element of dwelling as it pertains to the burglary statute?[FEC7] BRIEF ANSWERS Yes. Florida law defines entering as intrusion of any body part to commit the crime. An arm fits the definition of any body part because it is part of the body and can be used to commit the crime. Therefore, an arm qualifies as an entering body part under Florida law. No. Florida law states that a property in which a dwelling resides must [FEC8]have curtilage, and curtilage was [FEC9]defined as any form of enclosure surrounding a property. A detached garage would not be a dwelling, if its property is not surrounded by some form of an enclosure. Therefore, a detached garage on a property without curtilage would not qualify as a dwelling under Florida law[FEC10]. STATEMENT OF FACTS Mr. George Bailey has been convicted [FEC11]of burglary of a dwelling and is seeking help with his conviction. Mr. Bailey is an unemployed thirty-four year old male, who has resided at 320 Sycamore Street, Bailey Park Florida 33430 for nine years with his wife and four young children. He has been unemployed for approximately two years[FEC12]. Mr. Bailey seeks the help of counsel with his conviction of burglary of a dwelling. Specifically, the conviction of burglary as it pertains to Florida law. On May 27, 2016, Mr. Bailey was driving in the residential area of Pottersville looking for thrown out furniture to refurbish and resell. He came across a home with patio furniture sitting out on the curb for trash pickup,[FEC13] and decided to load it onto his truck. Before getting back into his truck, he glanced around for anything else to pick up. He then saw an electric sander sitting on a workbench inside an open garage window of the neighbors house, Mr. Ernie Bishop. Mr. Bailey advised, that he wanted the sander because most of his tools needed to be replaced and the small sander would allow for more refinishing of furniture than sanding by hand. The side of Mr. Bishops property[FEC14]where the garage is located, is lined with a short hedged wall[FEC15], which he thought would conceal him from being seen when taking the sander. Still standing on the property of the neighbors home, he reached over the hedge wall and into the partly open window with his arm, took the sander, and went back to his truck. Minutes later, he was stopped by police and arrested for burglary of a dwelling. Mr. Bailey was arrested on May 27, 2016[FEC16]at approximately 8:35 p.m. He was booked at approximately 9:00 p.m. on the same day, and was convicted of burglary of a dwelling with a $2,000.00 bond. He conviction is to be heard in front of a judge.[FEC17] DISCUSSIONN[FEC18] Mr. George Bailey will unlikely to be convicted [FEC19]of burglary of a dwelling, because[FEC20]although he meets the entry and intent elements[FEC21], he doe[FEC22]s not meet the element of dwelling because Mr. Ernie Bishops property does not have curtilage. In Florida, burglary is e[FEC23]ntering a dwelling, a structure, or a conveyance with the intent to commit an offense therein, unless the premises are at the time open to the public or the defendant is licensed or invited to enter . . . . Fla. Stat. Ann. ÂÂ § 810.02(1)(b)(1) (LexisNexis Effective July 1, 2016). To be convicted of burglary of a dwelling[FEC24]the prosecution would have to [FEC25]prove that Mr. Bailey meets the elements of entering, dwelling, and intent. The exceptions to the rule, are if the property was open to the public, if Mr. Bailey was a licensed professional performing work on the property, or if Mr. Bailey was a social guest invited onto the property.[FEC26] These exceptions were not factors in Mr. Baileys case. At the time of the burglary, Mr. Bishops property was not open to the public. It is a privately owned home located in a residential area of Pottersville. Additionally, Mr. Bailey did not personally know Mr. Bishop, nor was he hired by Mr. Bishop to perform any type of professional services. Mr. Bailey meets the intent element because he testified [FEC27]that his intention was to take the sander without being seen. Florida law states that proof of the entering of such structure or conveyance at any time stealthily and without consent of the owner or occupant thereof is prima facie evidence of entering with intent to commit an offense. Fla. Stat. Ann. ÂÂ § 810[FEC28].07(1) (LexisNexis 2016). In the Baker case, the Court used defendants stealthy entry [FEC29]as an evidentiary tool to establish the proof of intent to commit burglary. Baker v. State, 636 So. 2d 1342, 1344 (Fla. 1994). Therefore, by intending to steal the sander without anyone seeing him, Mr. Bailey used the coverage from the hedges to sneak his arm into the garage, which provides sufficient evidence to meet the intent element. Thus, the elements at issue here are entering and dwelling. Mr. Bailey meets the element of entering within the meaning of the burglary [FEC30]statute because he used his arm to take the sander from the window, and using any body part establishes entry. The entering element, is defined through case law. The Court states, [FEC31]the unqualified use of the word enter in a burglary statute does not confine its applicability to intrusion of the whole body but includes insertion of any part of the body or of an instrument designed to effect the contemplated crime. Polk v. State, 825 So. 2d 478, 479 (Fla. App. 2002).[FEC32]; see also Spearman v. State, 366 So. 2d 775[FEC33](Fla. Dist. Ct. App. 1978). Therefore, the issue at hand is whether Mr. Baileys arm provides sufficient evidence to establish the element of entering.[FEC34] Therefore, the entering element is satisfied when any body part enters a dwelling[FEC35]. Polk, 825 So. 2d 478[FEC36], 479. In the Polk case, the Defendant used his arm to unlatch a window in order to commit burglary. Id. The Court held that intrusion of any body part is sufficient enough to satisfy the entry of a dwelling within the meaning of the burglary statute. Id. at 480. Consequently, the element of entering is met when a person enters with any part of their [FEC37]body. Spearman, 366 So. 2d 775. In Spearman, the Defendant went to the front door and upon the door opening, struck the resident in the face. Id. The Defendant was ultimately charged with burglary and assault. Id. With respect to the burglary charge, the Court held that[FEC38]although his whole body did not enter the home, he entered when his arm and hand reached into the doorway and struck the resident. Id. at 776. The entry of any body part provided sufficient evidence for a conviction of burglary. Id. [FEC39] In this [FEC40]case, and similar to Polk and Spearman, where a part of the accuseds body entered a garage or a home, here, Mr. Bailey used a part of his body, his arm, to take the sander from an open window. As the Court held that intrusion of any body part is sufficient to establish an entry, Mr. Bailey meets the element of entering because[FEC41]as he stood in the neighbors property he entered Mr. Bishops property when he put his arm through Mr. Bishops garage window. Therefore, the entry of his arm would provide sufficient evidence to meet the entering element. Polk, 825 So. 2d 478; Spearman, 366 So. 2d 775. Thus, when Mr. Baileys arm to reach into Mr. Bishops open garage window while standing on the neighbors property, he satisfied the entering element because a part of his body entered Mr. Bishops property. [FEC42] Mr. Bailey does not meet the dwelling element within the meaning of the burglary statute because he burglarized [FEC43]a detached garage on a property that does not have curtilage. Florida law defines a dwelling [FEC44]as a building or conveyance of any kind, including any attached porch, whether such building or conveyance is temporary or permanent, mobile or immobile, which has a roof over it and is designed to be occupied by people lodging therein at night, together with the curtilage thereof. Fla. Stat. Ann. ÂÂ § 810.011(2) (LexisNexis 2016[FEC45]). The issue in Mr. Baileys case is whether[FEC46] the detached garage is considered a dwelling. A dwelling is established, when the property in which the dwelling resides has curtilage. [FEC47]Curtilage is a dwelling element that must be met. [FEC48]Florida law states that some form of an enclosure . . . must be present surrounding a residence to be considered part of the curtilage. . . . State v. Hamilton, 660 So. 2d 1038, 1045 (Fla. 1995). Additionally with regards to unattached structures, case law states that not having a form of barrier around extended residence of the curtilage, falls short of bringing unattached structures within the curtilage of the home. Martinez v. State, 700 So. 2d 142, 144 (Fla. Dist. Ct. App. 1997). Accordingly, when there is no form of enclosure[FEC49], a property does not have curtilage. Hamilton, 660 So. 2d 1038, 1045. In Hamilton, the Defendant attempted to burglarize outboard motors from a boat located on an unfenced backyard. Id. at 1039.The backyard was not enclosed by a fence, shrubs, or any form of a barrier. Id. Although there were a few spaced out trees around the property, the Court held that the property did not have curtilage and therefore[FEC50] the evidence did not support a conviction of burglary of a dwelling. Id. at 1046. Moreover, curtilage does not exist when the enclosure of a property does not surround all sides. Martinez, 700 So. 2d 142, 144. In Martinez, Defendant burglarized a sander from a detached garage, which had a driveway connecting the garage to the street. [FEC51]Id. at 143. The detached garage was located between the main house and the neighbors house. Id[FEC52]. Additionally, there was a fence bordering only two sides of the property[FEC53]. Id. The Court held that [FEC54]actual barriers are needed around the residence and unattached structures, to make it part of a curtilage of a home. Id. at 144. Therefore, the detached garage was not a dwelling because it was located on a property that did not have curtilage. Id. As such, the Defendant could not be convicted of burglary of a dwelling. Id. Specifically, a property has curtilage when an enclosure surrounds a property regardless [FEC55]of an opening for a driveway. Dubose v. State, 75 So. 3d 383, 385 (Fla. Dist. Ct. App. 2011). In Dubose, Defendants entered a property surround by a chain-linked fenced to commit burglary and fired bullets into the house. Id. at384, 385. The property was fenced in on all sides, with an opening for the driveway in the front. Id. at385. The Court held that an enclosure did not have to be completely closed to allow an opening for the driveway, and the open driveway did not prevent the property from having curtilage. Id. As such, the property satisfied the enclosure requirement for curtilage. [FEC56]Id. Furthermore, a property surrounded with enclosures has curtilage even with an opening at the driveway. Jacobs v. State, 41 So. 3d 1004, 1006 (Fla. App. 2010). Defendant burglarized [FEC57]aluminum siding from a vacant home surrounded by a fence. Id. at 1005. The property contained a fenced in yard on three sides, and a low-wall stoop at the front yard with an opening for the driveway. Id. at 1006. The Court held that the property had sufficient enclosure of some form to establish curtilage because all sides of the property were enclosed and an open driveway need not be part of the enclosure[FEC58]. Id. Now, [FEC59]in the instant case, a property does not have curtilage when there is no form of an enclosure surrounding the property. Mr. Bishops property has a chain-link fence in the backyard, a short hedge wall on one side, a short stone wall at the front of the property, and no barrier at all on the other side of the property.[FEC60]The Court in Hamilton, did not find the several unevenly spaced trees as sufficient enough evidence to support curtilage. Hamilton, 660 So. 2d 1038, 1047. Therefore, if having separated trees as an enclosure is not enough evidence for curtilage then, here, in the instant case not having a barrier at all is no evidence for curtilage. Similar to Hamilton, where the property lacked sufficient enclosure on part of the property, here, Mr. Bishops property lacks an enclosure on one side of the property, which lacks curtilage. Therefore, like in Hamilton, a court would find Mr. Bishops partly open property to lack curtilage. Analogously, a property lacks curtilage when it is not enclosed on all sides. Mr. Bishops property consists of a chain-link fence along the backyard, a line of three-foot hedges along the side of the property where the detached garage is located, and a short stone wall along the front yard with the driveway open. There is no boarder on the fourth side of Mr. Bishops property, that side is completely open. [FEC61]In Martinez, the Court held that not having a barrier surrounding the property, including the detached structures of a property, fall[s] short of bringing unattached structures within the curtilage of the home. Martinez, 700 So. 2d 142, 145. Almost similar to [FEC62]Martinez, where the property was enclosed on only two sides, here, Mr. Bishops property was enclosed on only three sides. Consequently, the lack of a boarder surrounding that fourth side of Mr. Bishops property, would deem the entire property, including the detached garage, as not having curtilage. Therefore, in t he instant case, the detached garage would not be considered a dwelling because its property is not enclosed on one side, which lacks curtilage. Nevertheless, a property has curtilage even when there is an opening for the driveway. In the instant case, among other types of enclosures around Mr. Bishops property, there is a short-stone wall at the front of the property with an opening for the driveway. In Dubose, the Court held that an enclosure need not be continuous . . . and that an unenclosed opening for ingress and egress does not preclude a determination that the yard is included in the curtilage of a house. Dubose, 75 So. 3d 385. Although, Dubose and Mr. Bishops properties are similar in that both have a low-walled stoop [FEC63]at the front of the property with an opening for the driveway, there is a difference as to the remaining sides of the properties to the cases respectively. In contrast to Dubose, where the remaining sides of the property were enclosed by a chain-link fence, here, in the instant case one of the remaining sides of Mr. Bishops property lacks some form of enclosure. [FEC64]Therefore, the unenclosed s ide of Mr. Bishops property, would lack evidence to satisfy curtilage to a dwelling. As such, the property where the detached garage is located would not have curtilage, and therefore the garage would not be considered a dwelling. Additionally, curtilage exist when an enclosed property has an open driveway. In the [FEC65]instant case, Mr. Bishops front yard has a short, stone wall with no gate in the driveway. In Jacobs, the Court held that the yard was delineated by some form of enclosure, and this enclosure included the opened driveway. Jacobs, 41 So 3d 1006. Although similar to Jacobs, where the property contained a low-walled stoop' with an open driveway, [FEC66]here, in the instant case Mr. Bishop also has a low stone wall with open driveway, however the main difference is the remaining sides of the properties. Id. In contrast, the property in Jacobs was fenced in on the remaining three sides, while in the instant case, Mr. Bishops property had enclosures on only two of the three remaining sides. Therefore, although Mr. Bishops front yard with the open driveway would still establish curtilage (on a fully enclosed property), having one side of the property without some form of enclosure does not provide cu rtilage. As such, Mr. Bishops property does not have curtilage. Since, Mr. Bailey burglarized [FEC67]a detached garage on a property that was not enclosed on all sides, it does not have curtilage, and therefore does not meet the dwelling element. CONCLUSION To be convicted of burglary of a dwelling, intent, entry, and dwelling are elements that must be met. Mr. Bailey satisfies the intent element because he had the intention of stealing the sander by hiding and reaching over the hedges. Mr. Bailey also satisfies the entry element because while standing at the neighbors property, his arm went into Mr. Bishops property through the open garage window. [FEC68]Mr. Bailey does not satisfy the dwelling element because the detached garage was located on a property that was not enclosed on all sides, which lacks curtilage. All elements of burglary of a dwelling must be met in order to be convicted. Johnson and Johnson Global Business In this report, we are using Johnson Johnson as the company for our strategic global business solutions project report. Introduction is formed as the brief background of Johnson Johnson. The focus of this report will be placed on JJs subsidiary Johnson Johnson, Group of Consumer Companies, Inc. Johnson Johnson. We will be focusing and relating this report on the baby product line of Johnson Johnson. The strategic initiatives of Johnson Johnsons skills, strategy, staff, structure, system and shared values will be discussed and examined in this report. We looked into their company functions so as to better understand them to enable effective decision makings. A political economic analysis is conducted to provide global risk insights for Johnson Johnson that is beneficial to JJ manage those risks as potential and risk. In relation to Johnson Johnson `s baby care products, Porter`s forces model is used to analyze the competitive advantage of the firm. One of the key understandings is that the middle-high rivalry is present with less number of competitors on Baby Care product line from competitor like California Baby, Simple. SWOT analysis show that Johnson Johnson holds strong competitive advantages after comparing its pros and cons despite of a few disadvantages of global standardization strategy. The growth strategy of Johnson Johnson will be selected based on both internal a nd external environment factor for the three years plan. These diagnoses are in reference to the SWOT analysis based on the company resources assets, intellectual property, and people. Lastly, the modes of entry will be affected by the several internal factors in this report. It comprises of internal requirement, technology know-how, management know-how as well as pressure for cost reduction. The recommendation part would provide several suggestions for the improvement of Johnson Johnson through the organization structure and Human Resource Management. Strategic Initiative of Johnson Johnson Skills As Johnson Johnson is a global manufacturer with many subsidiaries on a global scale, JJ would hire its employees through a stringent process of selection and focus on ones performance. This implies that JJ recruits people of experience and ability with a global mindset hires third-country national (TCN), indicating that recruitment of people is mainly dependent on being consistent with JJs organizational structure. Even though the various inputs from the suppliers, the competitive situations also exist among suppliers and large amount of substitute inputs contribute to the low power of suppliers. Financial environment Analysis on JJs operation results is essential for it allows its stakeholders to gain an insight on how JJ is performing on the global platform and whether the management strategy employed needs to be consistent or changed according to future market projections. Looking at JJs net sales figures in the last 5 years (Appendix 1), gathered from JJs 2009 annual report, we see a generally consistent growth in its net sales. Though there is a dip in worldwide sales figure of 2.9% ($61.9 billion) from 2008, this can be accounted with JJs spending on research and development ($7 billion) as well as acquisitions and collaborations.
